This practice is composed of seasoned specialists (of whom two are court appointed bankruptcy trustees) in complex domestic and cross border restructuring and insolvency matters. 

Our experience covers distressed acquisitions and sales, debt restructuring, insolvency proceedings as well as out of court refinancing.  Janson’s lawyers have assisted numerous distressed corporations in their transfer under judicial authority and also regularly lecture on this particular topic. 

We also have in depth expertise within the framework of voluntary or judicial liquidation of corporations. 

Janson is frequently consulted for the take-over of or participation in corporations in distress by private equity firms seeking a turnaround of such corporations enabling their continuity and yield recuperation.

  • Assisting creditors (banks or suppliers) in safeguarding their rights in the context of judicial reorganizations, bankruptcies or judicial liquidations

  • Acting as mediator for the holding corporation of a major bakery and restaurant chain in order to negotiate an amicable agreement with the holding corporation's creditors enabling the restructuring’s financing

  • Acting as court appointed trustee in a judicial liquidation procedure of a group of corporations with several millions of EUR worth of real estate assets in Belgium

  • Advising directors and a UK holding corporation on the bankruptcy and closure of shops in Belgium

  • Advising a foreign holding corporation on the closure of a Belgian entity of its group

  • Advising a Japanese conglomerate on the voluntary liquidation of several of their Belgian subsidiaries within the framework of a global restructuring

  • Advising and representing a Belgian outlet corporation with 23 shops in a judicial restructuring procedure

  • Advising a director of a major Belgian corporation regarding the nomination of court appointed directors enabling the protection of the corporation against foreign directors and shareholders

  • Representing Belgium’s four major banks as creditors to safeguard their interests in a judicial restructuring procedure

  • Advising court appointed trustees over a Belgian subsidiary in a dispute against its US holding corporation regarding, inter alia, the enforcement of a comfort letter

  • Cedric Alter is president of the Réseau Cap, a network of insolvency professionals (lawyers, judges, accountants).

  • Emmanuelle Bouillon and Lucille Bermond lecture several public institutions specialized in assisting companies in distress. Both Emmanuelle et Lucille are bankruptcy trustees to the Brussels ‘courts.

  • Cedric Alter is a member of the expert group entrusted by the federal government with the implementation of the Directive (EU) 2019/1023 of 20 June 2019 on preventive restructuring frameworks.
